Were You Fired From Your Job For Illegal Reasons?

Under Indiana law, you can be fired “at will” for poor performance or misconduct, as part of a workforce reduction, or for no particular reason. But you cannot be fired for an illegal reason such as discrimination or retaliation. Whether you are a licensed professional or a blue collar worker bee, you do have rights and you may be entitled to sue for wrongful termination if your employer acted outside the law.

Proving that you were wrongfully fired can be an uphill battle. The experienced employment rights lawyers of Cleveland Lehner Cassidy can determine if you have grounds for a lawsuit and faithfully advocate for you. We have prevailed in wrongful termination cases throughout Indiana, representing both private sector and government employees.

If you believe your employer has unfairly fired you, call our Indianapolis-based firm at 317-953-2600 for a free case evaluation.

Lawful Termination Versus Wrongful Termination

Employers have great latitude in hiring and firing. Employment is never guaranteed, no matter how long and faithfully you have served in the position. But all workers are protected by certain federal and state laws, including the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and others.

You cannot be fired for any of the following:

  • Discrimination against your race, color, sex, religion, national origin, age or disability
  • Retaliation for “blowing the whistle” on illegal activity
  • Making a report of illegal discrimination or harassment
  • Requesting a disability accommodation
  • Suffering a job injury or filing for workers’ compensation
  • Requesting Family and Medical Leave Act leave for your own health or to care for a family member
  • Getting pregnant or taking maternity leave

Federal employees have additional due process rights. They must be notified in advance of an intention to terminate their employment, with an opportunity to respond to the proposed separation and appeal the agency’s decision.

We Fight For Workers Like You

Both state and federal laws provide multiple protections for employees in the workplace. However, whether or not an employer is subject to those laws and whether a particular employee can take advantage of those protections is determined on a case-by-case basis. Cleveland Lehner Cassidy can help you understand and forcefully assert your rights.
