Defending Your Right To Be Pregnant At Work

The federal Pregnancy Discrimination Act of 1978 amended the Civil Rights Act to include specific employment protections for pregnant women.

It is illegal for employers to:

  • Refuse to hire or consider a female candidate because she is pregnant or may become pregnant
  • Consider pregnancy or future pregnancy in pay, benefits, training or advancement
  • Harass a pregnant employee or allow pregnancy harassment by coworkers
  • Refuse an accommodation to a pregnant women who has an underlying disability that is exacerbated by pregnancy
  • Refuse accommodations for new mothers (e.g., breast pump or breastfeeding breaks)
  • Fail to accommodate workplace restrictions when the employer accommodates similarly situated non-pregnant employees
  • Retaliate against the employee (demotion, transfer, discipline, termination)

If you have worked for your employer for at least one year and meet the other requirements of the Family and Medical Leave Act (FMLA), you may be entitled to take up to 12 weeks of unpaid leave from your job.
